Terms and Conditions

Insurance: 

The owner hereby declares to the renter that the owner possesses vehicle insurance that covers damages resulting from collision or accident. All vehicles are insured with liability, collision, fire, and theft coverage. In the case of an accident, the renter will be responsible for paying the deductible unless damages are less than the deductible, which we will assess upon the vehicle’s return. 

Insurance limitation and deductibles: $100,000 (USD) – $300,000 (USD), the liability deductible is $1000.00 (USD), collision deductible is $1000.00 (USD), fire deductible is $400.00 (USD), and theft deductible is $400.00. The owner shall retain credit card information that will be processed in the event of any loss or damage to the vehicle during the term of this agreement, to cover fully or partially the cost of the necessary repairs or replacement. In the case that there is no damage or loss, said credit card information will not be used and will be destroyed by the owner.

We advise you to be incredibly careful when driving, the roads may have debris or potholes that can cause damage to the tires or the vehicle. Small damage will not be covered under our insurance and is the responsibility of the renter.

Responsibility for damages, loss, tolls, or any traffic violations must be reported to the police.

In exchange for the use of this rental vehicle, you accept responsibility for any negligence on your part. The renter will be liable for all medical and legal claims,

that may arise from renting the car.

The renter is responsible for all damage, loss, or theft of the car; this includes damage caused by vandalism, weather, road conditions, and acts of nature, whether you are at fault or not. There is a $25.00 (USD) fee for losing the car mats and a $15.00 (USD) fee for losing the license plate.

The renter is responsible for any costs associated with repairs to the car. The renter will also be responsible if the car is not repairable or if we elect not to repair it, the renter will be responsible for the actual cash retail value of the car on the date of the loss. The renter will also be responsible for loss of use, diminished, value, appraisal fees, towing, impound, storage costs, and our administrative expenses. You must report all accidents or incidents of theft or vandalism to our office and the police as soon as you discover them. The renter is responsible for paying their tolls. All our vehicles come equipped with Panapass, the renter is responsible for adding money to the Panapass so that you can use the tolls booths without any additional fees. (in the case that your Panapass does not have money left there is a charge of $10.00 (USD) issued by the toll provider for not having enough credit on the pass). (*Tolls) Toll fines for toll evasion, parking citations, speeding tickets, and any other fines, fees, or penalties (*Infractions) assessed against us or the car during this rental. If the highway authorities notify us that we may be responsible for payment of a “Toll” or “Infraction”, in that case, the renter will pay the owner or a processing firm of our choosing an administrative fee of up to $50.00 (USD) for EACH “Infraction” or “Toll” incurred during the term of this rental. In the case that we or the processing firm pays for the “Tolls” or “Infractions,” the renter will need to authorize the owner and the processing firm to charge all payments and processing fees on the credit cards the owner has on file for this rental.

Prohibited Uses:

The following uses of the vehicle are prohibited and constitute a breach of this Agreement. A $5.00 (USD) per day surcharge will be applied to any driver under the age of twenty-one (21). The vehicle shall not be used by anyone who is not an Authorized Driver, does not have a driver’s license, or by anyone whose driver’s license is suspended. Anyone under the influence of alcohol, prescription, or non-prescription drugs, anyone who obtained the vehicle or extended the rental period by giving us false, fraudulent, or misleading information. Under these circumstances that could be considered a crime and not a minor traffic violation. Carrying dangerous or hazardous materials, illegal material, having persons or property for hire, pulling, or towing of anything. Any type of racing or speeding contest and transporting more people than the vehicle has seat belts for. The carrying of any person/persons outside the passenger cabin, or to transport children without approved child safety seats as required by federal and state law. Teaching anyone to drive, leaving with the vehicle outside of Panama, any unsecured cargo, tampering with the odometer, or disconnecting it. As the driver, when you know the vehicle is not in a reasonable condition to drive it further because it would be damaged. When applicable, by anyone who lacks experience driving a vehicle equipped with manual transmission. Driving in or through an underpass or other object where there is insufficient clearance (width or height), and the removal of tracking device/es from the vehicle is also in breach of this Agreement.

For pickup and returns the vehicle MUST be dropped off at our office in Nueva Gorgona. No exceptions. In case the highways may close, or any other events or proceedings occur the vehicle must still be dropped off at our office. If the vehicle is not dropped off at our office, a fine of $150.00 (USD) at the time of inspection will be charged for any damage. The renter will have up to 2 hours courtesy time for the return of the vehicle. Anything after the 2 hour period the renter will be charged 1 additional day.

Modifications:

This Agreement constitutes the entire agreement between the renter and the owner. All prior representations and agreements between the renter and owner regarding this rental are voided. No terms of this Agreement can be waived or modified. 

If you wish to extend the rental period, you must obtain our permission before the “Due-In Date”, we may require the renter return the vehicle to our rental office for inspection.

Renter Responsibility:

Owner/Lessor/Employees shall not be liable for disappearance or damage to any property left, stored, or transported by renter or other persons, in or on the vehicle, either before or after it has been returned to lessor.
